June 2026 Infrastructure Committee Report
Making Good Progress

The Infrastructure Committee has provided the updated prioritized list of our requests from Epcon to our HOA board. We have agreed to work with the board to get each of these 30-plus issues addressed.
The list mostly is composed of the nonconformances documented in the Transition Study report from our independent engineering firm. It also includes some maintenance items that were not well-maintained over the past few years, plus a standing-water situation reported to us by a neighbor.
To bolster the board’s negotiating position, we obtained bids on a few items for which the report did not include cost estimates.
We continue to make progress with Epcon Land Management on retaining wall issues. Epcon has provided much of the missing documentation on the walls. We still have a few walls that have not been fully permitted by the city of Durham, and Epcon has agreed to work with the city to get this completed. We also walked the nonconforming walls with Epcon, and they have agreed to make repairs to those walls very soon.
We are advising the board on items on the warranty punch list for the new amenities.
Based on our contacts at the city’s Planning and Inspection Department and Epcon, we anticipate resubmission for permitting the Phase 1 stormwater control measures ponds and level spreader soon. We have communicated some observations about the ponds to the city so our concerns will be considered before permits are issued. One of these issues involves an invasive plant believed to be introduced by subcontractors of the developer. This was brought to our attention by a neighbor.
